But here's where it gets controversial: South Australia's Police Commissioner, Grant Stevens, has publicly voiced his deep concerns, admitting he was only made aware of the sentencing recently due to an "oversight." Commissioner Stevens has reached out to the Director of Public Prosecutions (DPP) for further counsel, specifically questioning the appropriateness of a suspended sentence for such a serious offense. And this is the part most people miss: In this particular case, Alisha Naomi Renee Gray was sentenced in December to one year, eight months, and eight days in jail. However, a District Court judge suspended this sentence, opting for an 18-month good behaviour bond. The court heard that the assault occurred during an altercation at the Ceduna Football League grand final. The officer sustained multiple facial lacerations, requiring surgery and experiencing prolonged pain. Judge Anne Barnett cited Gray's genuine remorse, her young family, the special needs of her two children, and her lack of prior criminal history as factors influencing her decision to suspend the sentence. The prosecution, acting on instructions from the DPP, did not argue against a suspended sentence, even indicating it might be appropriate.
Chief Justice Kourakis further clarified that the assault, while serious, was not a "glassing" that would typically lead to scarring. He also stressed that police and the Commissioner's office are entitled to communicate their views to the DPP, who then decides on the prosecution's stance. "An important question is, what did senior police and investigators say to the director? Did the director explain why he wasn't going to ask for a custodial sentence?" he questioned, suggesting that clearer communication from the outset could prevent such controversies.
